Post: #11 Fucking Cheek Complicated old bit of law this, dates back to the 1920s....which in the grand scheme of things isn't really that old. Pretty much the club can use the image, because they bought the use from whoever took the photo. Basically if you use a person's image in a way that seems to promote your business without their permission then that would be a breach of "image rights", especially if it damages the celebrity's goodwill. There's some other tests that court apply but I can't remember them, but I thinhk the goodwill test is the most important. So.... If they'd used Robson's image in a way that implied he was supportive of the Ashley regime then that would be damaging to his reputation, and therefore his goodwill would affect his ability to "sell" his own image. Quite a funny case of Irvine v Talksport. Eddie Irvine was used in a picture by Talksport in way that implied he'd endorsed the shitty radio station. He hadn't. He won. On the flip side, the Spice Girls sold their exclusive image rights to Aprilla Motorcycles for a promotional campaign in full knowledge that Geri Halliwell was leaving, meaning that Aprilla had paid for an image that no longer existed. Aprilla won about half a million plus costs

The NUSC had a meeting around about 8 weeks ago, they asked if anybody from the club could attend.The club said no, but sent some corporate leaflets asking the NUSC to hand them out to the people who attended.
